Petting a service dog? No! Why?(read description)
Please do not pet any service dog! Yes, you can of course ask though but ask the handler before and don’t try to distract the dog while asking, just basically ignore and pretend the dog isn’t there when asking or doing anything!
Why? Service animals have been titled as medical equipment since 1990 (long-ish time, ik😅) and it’s been stated in law that distracting a service animal is ILLEGAL since it interferes with the medical safety of the handler! Distracting a service animal can mean making noises to the dog, talking to the dog, petting the dog/touching it in any way, your own pet/service animal distracting (barking, lunging, growling, etc), feeding, pictures, etc (basically any way you can possibly get the animals attention intentionally is considered distracting it). So yes, service animals are allowed to public access since they are legally protected as medical equipment.
NO. Service animals are NOT any other animal besides dogs or miniature horses, other animals that are titled “service animals” are NOT legitimate nor protected under the ADA law (that means cats, goats, pigs, sheep, etc are NOT protected or legitimate service animals.)
Service animals are NOT emotional support animals, therapy animals, emotional support stuffed animals, protection animals, government animals, etc.
Emotional support animals/ESA’s can be any animal that provides comfort to ONE individual and do NOT have public access rights, they are only allowed to housing that restricts pets.
Therapy animals/TA/TD are animals that provide comfort to MULTIPLE individuals and do NOT have public access rights, they are only allowed to facilities (therapy facilities, hospitals, etc) that give access to the animal and non-pet friendly housing.
Emotional support stuffed animals/ESSA’s are stuffed animals that provide comfort to a person that finds grounding in the stuffed animals and are allowed to take it anywhere because it is not an actual living animal BUT labeling it as a service animal is considered impersonating medical equipment but it won’t have charges or fines since it’s not a living animal (or at least I know of)
Protection animals/government animals/K9’s are dogs that work in protecting individuals(for one or many) and or dogs that are working for police or any military force. Protection dogs for a person(or many) is NOT allowed public access however government animals ARE allowed to public access HOWEVER they are not allowed to wrongly interfere with innocent individuals, distract service animals, or wrongly be a thereat to someone who isn’t a criminal (this means that they cannot legally bite an innocent individual, only if the handler gives the command to bite a CRIMINAL ONLY)
Service animals are medical equipment and have public access anywhere EXCEPT sterile areas (surgery rooms, restaurant kitchens, etc) and also areas that are a threat to their safety, that means that on amusement rides they aren’t allowed to be on rides that include straps or any way to hold in a person!
If a person is allergic to a service animal, both parties MUST be accommodated and CANNOT be favored more or less.
