ถ้าใครค้นหา “said to contain คืออะไร” หรือ “STC ย่อมาจากอะไร” แบบอยากได้คำตอบสั้นๆ เลย—STC = Said To Contain ค่ะ เป็นคำที่เจอบ่อยมากบน Bill of Lading (B/L) และมักไปอยู่ใกล้ๆ รายการสินค้า เช่น “STC: 500 CARTONS OF SHOES” สิ่งที่คนมักเข้าใจผิดคือ เห็นมีรายการสินค้าแล้วคิดว่า “สายเรือรับรองจำนวน/ชนิดสินค้าแล้ว” แต่ความหมายของ STC คือ “ตามที่ผู้ส่งออกแจ้งว่าในตู้มี…” เท่านั้น สายเรือ/ตัวแทนไม่ได้เปิดตู้มานับให้จริงทุกชิ้น (โดยเฉพาะตู้คอนเทนเนอร์ที่ผู้ส่งออกเป็นคนบรรจุและซีลมา) เพราะฉะนั้น STC จึงเกี่ยวกับเรื่อง “ขอบเขตความรับผิดชอบ” มากๆ เวลามีปัญหาหน้างาน จากที่เคยเจอเคสจริง เวลาเกิดปัญหาเช่น ของมาไม่ครบ ของไม่ตรงรุ่น หรือมีบางกล่องหาย ผู้รับมักอยากอ้างเอกสารขนส่งเป็นหลัก แต่พอใน B/L ระบุ STC ไว้ การไล่ความรับผิดชอบจะย้อนไปที่ข้อมูลที่ shipper (ผู้ส่งออก) เป็นคนแจ้งและเป็นคนบรรจุของลงตู้เอง ดังนั้นเอกสารต้นทางอย่าง Packing List/Invoice และข้อมูลที่ใช้ทำ B/L ต้อง “ตรงกัน” มากที่สุด ไม่งั้นตอนเคลมจะเหนื่อย ทริกที่เราใช้เช็กก่อนปล่อยให้เอกสารออก (เผื่อเป็นประโยชน์กับมือใหม่ import-export) 1) เทียบคำบรรยายสินค้า (Description) ใน Invoice vs Packing List vs Draft B/L ให้เป็นเรื่องเดียวกัน 2) เช็กจำนวนหน่วยบรรจุ (เช่น cartons, bags, pallets) และน้ำหนักรวม (G.W.)/ปริมาตร (CBM) ว่าสอดคล้องกัน 3) ถ้าสินค้ามีหลายรุ่น/หลายสี แนะนำให้ให้ผู้ส่งออกใส่รายละเอียดใน Packing List ให้ชัด และอย่าปล่อยให้ B/L เขียนกว้างเกินไปจนตีความยาก 4) ถ้าเป็นของมูลค่าสูงหรือเสี่ยงเสียหายง่าย ลองพิจารณาเพิ่มการตรวจนับ/ถ่ายรูปตอนโหลดตู้ หรือให้ third-party inspection ช่วย (แล้วเก็บหลักฐานไว้) สรุปคือ STC (Said to Contain) ไม่ได้น่ากลัว แต่ต้อง “อ่านให้ขาด” ว่าเป็นข้อมูลที่ผู้ส่งออกแจ้ง และสายเรือไม่ได้การันตีเนื้อหาข้างในตู้ ถ้าเราตรวจเอกสารก่อนยื่น และเก็บหลักฐานตั้งแต่ต้นทาง จะช่วยลดความเสี่ยงตอนเกิดข้อพิพาทหรือเคลมได้เยอะมากค่ะ
