On September 9, 2025, there was an unexpected crash in Port of Long Beach, LA 🇺🇸, when over 67 containers fell off the Zim Mississippi ship while docking. ⚠️
In addition to damaging cargo containers and other ships, goods such as shoes 👟, clothing 👕, and airline equipment 🛫 rise to the surface!

1️⃣ Shipping Lines (Carrier) - ZIM
Responsible for the safety of the goods. 🚢
Arrange and hold the container rigid.
According to the Hague-Visby Rules, damage is responsible, but there are restrictions such as force majeure. 🌪
2️⃣ Port Authority / Terminal Operator - Port of Long Beach & Pier G
Control security in the port area. ⚓
If the equipment or operation of the port is the cause, it may be co-responsible.
3️⃣ Shipowner (Shipowner) - MPC Container Ships
Normally responsible for the boat lease. 📄
If a ship's structure or equipment is found to be in trouble, a lawsuit may be filed.

หลายคนถามผมบ่อยว่า “ถ้าตู้คอนเทนเนอร์ร่วงจากเรือ สินค้าหาย/เสียหาย เราต้องเริ่มทำอะไร และใครจะจ่าย?” จากเคสแนว ๆ ZIM Mississippi สิ่งที่ผมแนะนำ (ในมุมคนทำงานโลจิสติกส์) คือให้โฟกัส 3 เรื่อง: หลักฐาน, เอกสารขนส่ง, และช่องทางเคลม 1) รีบเก็บ “หลักฐาน” ให้ครบตั้งแต่นาทีแรก - ขอรายงานเหตุการณ์จากสายเรือ/ท่าเรือ (Incident report) ถ้ามี - เก็บภาพ/วิดีโอสภาพตู้ สภาพสินค้า หมายเลขตู้ (Container No.) และซีล (Seal) - ทำรายการสินค้าเสียหาย/ขาดหาย (damage & shortage list) ให้ละเอียด รวมถึงมูลค่าตามใบกำกับ หลักฐานพวกนี้สำคัญมากเวลาเจรจาความรับผิดชอบและเวลายื่นเคลมประกัน 2) อ่าน Bill of Lading ให้เป็น โดยดู 4 จุดนี้ก่อน - ข้อจำกัดความรับผิด (Liability limitation) ของสายการเดินเรือ - เงื่อนไข “ข้อยกเว้น” เช่น เหตุสุดวิสัย/สภาพอากาศ/อุบัติเหตุทางทะเล - เงื่อนไขการแจ้งเคลมและระยะเวลา (Notice period / Time bar) - ระบุว่าเป็นการขนส่งแบบใด (Port-to-Port หรือ Door-to-Door) เพราะมีผลต่อผู้รับผิดชอบช่วงต้น-ปลาย ในชีวิตจริง แค่ส่งเอกสารช้าหรือแจ้งเหตุไม่ทันกรอบเวลา ก็อาจเสียสิทธิได้ 3) แยกให้ชัดว่า “ผู้รับผิด” กับ “ผู้จ่ายก่อน” อาจไม่ใช่คนเดียวกัน ต่อให้สุดท้ายพิสูจน์ได้ว่าสายเรือหรือผู้เกี่ยวข้องต้องรับผิด แต่กระบวนการพิสูจน์มักใช้เวลานาน ผมเลยมักย้ำเรื่อง Cargo Insurance เพราะประกันช่วยให้ได้เงินชดเชยเร็วขึ้น แล้วค่อยให้บริษัทประกันไปไล่เบี้ย (subrogation) กับฝ่ายที่ต้องรับผิดภายหลัง 4) เช็กลักษณะความเสียหาย: เสียหาย, สูญหาย, หรือล่าช้า - เสียหาย/สูญหาย: มักเคลมได้ชัดกว่า หากเอกสารครบ - ล่าช้า (Delay): หลายกรมธรรม์/หลายเงื่อนไข B/L อาจไม่คุ้มครองเต็ม ๆ ต้องดู “ผลกระทบทางธุรกิจ” เช่น สินค้าพลาดฤดูกาลขาย หรือค่าใช้จ่ายเพิ่ม 5) ทำแผนสำรองแบบที่ใช้ได้จริง จากประสบการณ์ ผมจะทำอย่างน้อย 2 ชั้น - ชั้นปฏิบัติการ: มี supplier สำรอง/route สำรอง/เผื่อ lead time - ชั้นเอกสาร-การเงิน: เตรียม invoice/packing list/สัญญาซื้อขาย/หลักฐานต้นทุนไว้พร้อมยื่นเคลมทันที สุดท้าย ถ้าคุณเป็นเจ้าของสินค้า อย่ารอให้ “รู้ว่าใครผิดก่อน” แล้วค่อยทำอะไร ให้เริ่มจากการแจ้งเหตุ-เก็บหลักฐาน-เช็ค B/L และติดต่อประกันพร้อมกันไปเลย จะลดเวลาและลดความเสียหายได้มากครับ ปล. ถ้าคุณทำคอนเทนต์สายโลจิสติกส์เหมือนกัน ผมเห็นคำว่า LOGISTICS MAN / SUBSCRIBE / ALL ABOUT LOGISTICS บ่อยในวงการ—ลองใช้เป็นแนวทางทำซีรีส์สั้น ๆ เรื่อง Shipping Risk, Container Accident, และวิธีอ่านเอกสารขนส่ง จะช่วยให้คนค้นหาเจอและเข้าใจง่ายขึ้นครับ
