ในช่วงเวลานี้ปัญหาการแก้ไขรัฐธรรมนูญกลายเป็นประเด็นที่ทำให้ความเชื่อมั่นของประชาชนตกอยู่ในความไม่แน่นอนอย่างยิ่ง โดยเฉพาะเมื่อมติของรัฐสภาและคณะรัฐมนตรีไม่สอดคล้องกันและขัดแย้งกับคำวินิจฉัยของศาลรัฐธรรมนูญ ทำให้เกิดความสับสนในขั้นตอนและทิศทางของการแก้ไขรัฐธรรมนูญอย่างชัดเจน หนึ่งในหัวใจสำคัญของความขัดแย้งนี้คือการเลือกคำถามประชามติในวันที่ 18 ธันวาคม 2568 ซึ่งรัฐสภาเลือกใช้คำถามที่ว่า “ท่านเห็นด้วยหรือไม่ที่จะให้มีการจัดทำรัฐธรรมนูญฉบับใหม่” ขณะที่คณะรัฐมนตรีเน้นคำถามที่ว่า “ท่านเห็นชอบว่าสมควรมีรัฐธรรมนูญฉบับใหม่หรือไม่” ทั้งสองคำถามนี้แม้จะดูคล้ายคลึงกัน แต่การตีความและผลตามมานั้นมีความแตกต่างกันอย่างมาก โดยเฉพาะอย่างยิ่งเมื่อนำไปพิจารณาร่วมกับคำวินิจฉัยของศาลรัฐธรรมนูญที่ระบุว่าการทำประชามติจะต้องแบ่งออกเป็น 3 ครั้ง (หรือรวมกัน 2 ครั้ง) เพื่อให้ประชาชนมีโอกาสรับรู้และตัดสินใจในทุกขั้นตอน ปัญหานี้สะท้อนให้เห็นถึงความไม่รอบคอบในการจัดทำและร่างคำถาม รวมถึงความหละหลวมในกระบวนการทางการเมือง ทั้งนี้ยังชี้ให้เห็นว่าการขาดความชัดเจนและความเข้าใจที่ตรงกันในหน่วยงานรัฐสำคัญส่งผลกระทบต่อสิทธิและเสียงของประชาชนในการกำหนดอนาคตของประเทศ นอกจากนี้ ยังมีข้อกังวลเกี่ยวกับมาตรา 112 ที่อาจถูกหยิบยกขึ้นมาใช้เป็นเครื่องมือในการจำกัดสิทธิและการแสดงความคิดเห็นของประชาชน หากการแก้ไขรัฐธรรมนูญกระทบถึงมาตรานี้ ก็อาจก่อให้เกิดการปะทะทางการเมืองที่รุนแรงและไม่เป็นผลดีต่อความสงบสุขของสังคม การแก้ไขรัฐธรรมนูญจึงควรเริ่มต้นด้วยความโปร่งใส ชัดเจน และเป็นประโยชน์ต่อประชาชนจริง ไม่ใช่เป็นเครื่องมือของนักการเมืองหรือกลุ่มผลประโยชน์ใด ๆ ความเข้าใจที่ชัดเจนในข้อกฎหมาย กระบวนการประชามติ และคำวินิจฉัยศาลรัฐธรรมนูญ ถือเป็นพื้นฐานที่สำคัญที่จะนำไปสู่การแก้ไขรัฐธรรมนูญที่ถูกต้องและยั่งยืน
