# Constitution of the Kingdom of ThailandThe Constitution of the Kingdom of Thailand, Buddha, 2017, Article 169, requires that a cabinet that is vacant from the dissolution of the House of Representatives shall perform its duties under four conditions:
1. Do not act as a result of approving a work or project or as a result of establishing a commitment to the next Council of Ministers, unless already defined in the annual expenditure budget;
2. Do not appoint or evacuate civil servants whose positions or salaries are regular or employees of government agencies, enterprises or affairs in which the State holds a majority stake; or place such persons out of duty or out of office; or substitute others to perform their duties unless agreed by the Election Commission (SEC) first;
3. Do not act as a result of approval to spend the reserve budget on an emergency or necessary basis unless agreed by the SEC first.
4. Do not use the resources of the State or government personnel to perform any act that may affect the election and do not act in violation of the prohibitions imposed by the SEC.
ในช่วงที่รัฐบาลรักษาการกำลังดำเนินการภายหลังการยุบสภาผู้แทนราษฎร ข้อจำกัดในการบริหารประเทศจึงเป็นเรื่องที่ประชาชนและผู้ที่สนใจติดตามอย่างใกล้ชิด โดยเฉพาะอย่างยิ่งเรื่องโครงการที่เกี่ยวข้องกับการใช้จ่ายงบกลางหรือโครงการที่อาจมีผลผูกพันรัฐบาลชุดต่อไป เช่น โครงการคนละครึ่งพลัสเฟส2 ซึ่งได้รับความสนใจอย่างมากในวงกว้าง ตามข้อความจากมาตรา 169 ของรัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ. 2560 กำหนดให้รัฐบาลรักษาการที่พ้นจากตำแหน่งต้องปฏิบัติหน้าที่ภายใต้เงื่อนไขสำคัญ 4 ข้อ เพื่อป้องกันมิให้เกิดการบริหารบ้านเมืองที่อาจส่งผลกระทบต่อนโยบายหรือทรัพยากรรัฐในระหว่างช่วงเปลี่ยนผ่าน โดยเฉพาะการไม่สามารถอนุมัติงบประมาณรายจ่ายประจำปีใดที่สร้างภาระผูกพันให้รัฐบาลใหม่ ยกเว้นโครงการที่ได้รับการกำหนดไว้แล้วในงบประมาณรายจ่ายประจำปีนั้นๆ ข้อนี้ทำให้รัฐบาลรักษาการไม่สามารถดำเนินโครงการคนละครึ่งพลัสเฟส2 ได้ในช่วงเวลาดังกล่าว เพราะจะเป็นการผูกพันงบประมาณและนโยบายกับรัฐบาลชุดใหม่ ซึ่งขัดต่อบทบัญญัติของรัฐธรรมนูญ และต้องได้รับความเห็นชอบจากคณะกรรมการการเลือกตั้ง (กกต.) หากมีกรณีฉุกเฉินหรือจำเป็นในการใช้จ่ายงบประมาณสำรอง ยิ่งไปกว่านั้น รัฐบาลรักษาการยังถูกจำกัดในเรื่องการแต่งตั้ง การโยกย้ายข้าราชการและการใช้ทรัพยากรของรัฐเพื่อประโยชน์ในช่วงเลือกตั้ง เพื่อรักษาความเป็นกลางและความโปร่งใสทางการเมือง รวมถึงป้องกันการใช้อำนาจในทางมิชอบในระหว่างช่วงเปลี่ยนผ่านรัฐบาล สำหรับประชาชนหรือผู้ที่ติดตามโครงการช่วยเหลือต่างๆ เช่น คนละครึ่งพลัส จึงต้องทำความเข้าใจว่า แม้โครงการเหล่านี้จะมีความสำคัญในการกระตุ้นเศรษฐกิจและช่วยเหลือประชาชน แต่รัฐบาลรักษาการนั้นมีข้อจำกัดตามกฎหมาย ทำให้ต้องรอการสานต่อหรือการอนุมัติโครงการจากรัฐบาลชุดใหม่ที่จะเข้ามาทำหน้าที่อย่างเต็มตัวหลังการเลือกตั้ง ดังนั้น การติดตามข่าวสารจากแหล่งข้อมูลทางการ รวมถึงการทำความเข้าใจข้อกฎหมายและสถานการณ์ปัจจุบันจะช่วยให้ประชาชนได้รับข้อมูลที่ถูกต้อง และไม่เกิดความสับสนในช่วงเวลาที่รัฐบาลรักษาการยังจำกัดอำนาจในการทำโครงการผูกพันงบประมาณต่อไป
