Court of Appeal couldn't agree on who gets the rent!

That's how contentious a property ownership issue can become if parties involved didn't behave consistently with their claim.

T was a registered co-lessee of a coffeeshop with his late mother. He wanted his share of rent collected - sounds fair right?

But 2 judges on the Court of Appeal decided because of various things which T did, he intended for his late mother to be the sole beneficial owner of the lease.

🤐 T didn't participate much in the coffeeshop's management.

🤐 His late mother wrote a letter stating that she was entitled to all the rent, and he didn't object.

🤐 Although he only received his share of the rent partway through the lease, he didn't make any claims for the arrears for many years.

1 judge dissented. He concluded that there was a partnership between T and his late mother, and therefore he should be entitled to part of the rent.

Unfortunately in a split ruling, the majority decision is final. So T lost out because he didn't behave as if he was fully entitled to the rent.

Consistent behaviour is key, especially when the dispute stretches over many years. Otherwise, even judges may not agree amongst themselves.
