With the rise of mobile technology and electronic health records, safeguarding ePHI has become a major challenge, increasing the potential for common violations. Lost and stolen devices pose a considerable risk, as mobile smartphones, laptops, and tablets often contain sensitive ePHI that can be accessed if not properly secured. Hacking incidents can result from weak cybersecurity measures, making healthcare organizations accountable for breaches. Dishonest employees represent another risk; trust among staff is important, but regular monitoring and background checks help minimize intentional violations. Improper disposal of documents containing PHI, such as failing to shred paper records, can lead to unauthorized access. Accidental third-party disclosures occur when medical staff inadvertently share PHI with unauthorized individuals. HIPAA mandates securing all paper and digital records to prevent this. Lack of adequate training also contributes to violations, emphasizing that all employees who handle PHI must undergo comprehensive HIPAA training. Additionally, discussing any PHI in public or unsecured locations (referred to as "the blabbermouth" violation) is strictly prohibited. HIPAA requires precautions to prevent discussions that may expose sensitive information. Healthcare providers and organizations should implement robust policies including encryption, secure disposal methods, access controls, regular staff training, and incident response plans to maintain compliance and protect patient privacy. Proactively addressing these common violation areas will reduce the risk of data breaches and ensure trust in the healthcare system.
