Surrogate contracts 📄
Once we finished matching, we moved into the legal side of surrogacy… and this part can be intense.
Our first contract arrived in January 2025 — all 59 pages of it. It needed adjustments, clarifications, and rewrites, and we didn’t finish signing until March. Then, due to unforeseen circumstances, we officially terminated that contract in August.
But God had already prepared my next step.
My second contract was so much smoother — 29 pages with a 5-page addendum. It was drafted in August, and by early September we were fully signed and ready to move forward.
This part isn’t glamorous, but it’s necessary. It protects everyone — the surrogate, the intended parents, and the baby.
Sometimes things fall apart… so the right things can fall into place.

Surrogacy contracts play a critical role in the surrogacy process, ensuring clear legal protections and responsibilities for all parties involved—the surrogate, the intended parents, and ultimately the child. While often lengthy and detailed, these contracts establish the foundation for trust and clarity, minimizing potential disputes. The experience shared illustrates how the initial contract, despite its substantial 59 pages, required numerous revisions and eventual termination due to unforeseen circumstances, highlighting the complex nature of legal agreements in surrogacy journeys. This is common as each party strives to ensure that terms are fair, comprehensive, and adaptable to changing situations. Subsequently, the second contract, significantly shorter at 29 pages with a detailed 5-page addendum, underscores how clarity and conciseness can enhance the legal process, facilitating quicker agreement and readiness to proceed. Such streamlined contracts often benefit from previous experiences and refined legal templates, making the process smoother for everyone involved. Beyond legalities, many intended parents and surrogates find comfort in faith and timing—as reflected in the repeated themes of "God’s timing, God’s path, God’s protection" from the contract documents and captions. These spiritual elements can provide emotional resilience during challenging phases. Importantly, these contracts are not just legal paperwork; they represent the building blocks of new families and the protection of everyone’s future. Compliance with legal standards safeguards the surrogate’s health and rights, ensures parental rights for intended parents, and secures the welfare of the child. Each clause—from healthcare decisions and confidentiality to compensation and contingency plans—must be carefully negotiated. If you’re embarking on a surrogacy journey, it’s crucial to work closely with experienced legal professionals specialized in reproductive law. They will help customize contracts that address unique circumstances and ensure protection. Remember, while the process may feel intense and complex, it ultimately lays the groundwork for beautiful, lasting outcomes in family building. Having faith that sometimes things fall apart so the right things can fall into place is a powerful mindset during this journey. Trusting the process—emotionally, legally, and spiritually—can make the surrogacy experience deeply rewarding for everyone involved.
