"Hello, I am a Myanmar (Burmese), or Thai people like to call it an alien. I am a native Myanmar, although I was born in Thailand in Trang Province, but my parents are from Myanmar, who came to work in Thailand. When I grew up, I came to work as an employee at Tai Khoi Market to transport goods to customers. If you ask about wages per day, it is not worth the work. Tired and sometimes have to meet people who do not treat us well, but in a small part (speaking in a sad voice)."
"I like Thailand, even though it's a little difficult for me because I can't speak clearly, haha. (Laughter) But everything is very good."
"I want Thai people to look at me as Thai, even if it's not. I want to be treated well or seen as ordinary people, not divided."
Summary of the laws of the person interviewed
: The interviewee is considered an alien according to the 1965 Nationality Act because the interviewee's father and mother are Myanmar nationals who enter Thailand. Even if the interviewee is born in Thailand, they will not automatically acquire Thai nationality under section 7 bis.
1) Principle of nationality
Nationality is a legal relationship between a person and a state that contributes to the rights, duties, and protections of the state. Each country's nationality may be based on Jus Sanguinis or Jus Soli, or share both principles. According to the fact, the interviewee's parents are nationals of Burma (Mianma), and the interviewee was born in Thailand, although born in the Kingdom of Thailand, but being born in Thailand alone does not automatically contribute to Thai nationality because Thai law specifically determines the condition of citizenship by birth. Therefore, the interviewee is entitled to Burmese citizenship by descent. Parents unless they enter the Thai Nationality Act.
2) Main domicile
Domicile refers to a place where a person settles or lives normally and is a place where the law is used as a criterion for determining the rights, duties, or jurisdiction of a government agency in some cases. According to the information of the person interviewed, they were born and live in Thailand, so they may be considered domiciled in Thailand, even if their nationality is Burmese. Domicile in Thailand affects the contact of government, education, access to government services, and exercise of certain rights under Thai law. Domicile and nationality are the main laws with different legal meaning and consequences, so it is not always necessary for a person to have domicile and nationality in the same country.
จากประสบการณ์จริงที่ได้สัมผัส ชีวิตของคนเมียนมาร์ในประเทศไทยไม่ใช่เรื่องง่าย แม้ว่าบางคนจะเกิดที่ไทย แต่ด้วยข้อกฎหมายเรื่องสัญชาติ ทำให้พวกเขาไม่ได้รับสัญชาติไทยโดยอัตโนมัติ ประเด็นนี้สร้างความท้าทายในการเข้าถึงสิทธิพื้นฐาน เช่น การศึกษา การรักษาพยาบาล และการทำงานอย่างถูกต้องตามกฎหมาย ในแง่ของการใช้ชีวิต ผู้ถูกสัมภาษณ์เล่าถึงความยากลำบาก เช่น งานที่หนักและรายได้ไม่คุ้มค่า อีกทั้งยังเคยเจอการปฏิบัติที่ไม่ดีจากบางคน ซึ่งสะท้อนถึงปัญหาการแบ่งแยกและความเข้าใจผิดในสังคมไทย ถึงแม้จะมีอุปสรรคเหล่านี้ คนเมียนมาร์ก็ยังชื่นชอบประเทศไทย และอยากได้รับการยอมรับเหมือนคนไทยทั่วไป ในเรื่องของกฎหมาย สัญชาติไทยไม่ได้มาจากการเกิดในประเทศเพียงอย่างเดียว แต่ขึ้นอยู่กับหลักเกณฑ์ที่เข้มงวดมาก เช่น ต้องมีสถานะพิเศษหรือผ่านกระบวนการขอรับสัญชาติ นอกจากนั้น ภูมิลำเนาที่อยู่อาศัยในไทยก็ช่วยให้ได้รับบริการและสิทธิในบางด้าน แม้ว่าสัญชาติจะยังคงเป็นสัญชาติเมียนมาร์ก็ตาม สำหรับคนที่สนใจอยากเข้าใจความซับซ้อนของสถานการณ์คนต่างด้าวในไทย ความรู้เรื่องสัญชาติและภูมิลำเนาเป็นสิ่งสำคัญที่จะช่วยให้เห็นภาพรวมและความเป็นจริงที่ทุกคนควรรับทราบ พร้อมทั้งเปิดโอกาสให้สังคมไทยได้พัฒนาทัศนคติและนโยบายที่เหมาะสม เพื่อให้คนทุกสัญชาติได้อยู่ร่วมกันอย่างเท่าเทียมและมีคุณภาพชีวิตที่ดีขึ้นอย่างแท้จริง รวมถึงในด้านการศึกษาและการดำเนินชีวิตในสังคมใหม่ การเข้าใจและเคารพซึ่งกันและกันเป็นฐานสำคัญที่จะช่วยลดปัญหาความขัดแย้งและส่งเสริมความสามัคคีในสังคมหลากหลายวัฒนธรรมแบบนี้ได้อย่างยั่งยืน
