A lot of people say, “If you’re undocumented, follow the law. Go to court. Do it the right way.”

But what happens when someone does exactly that — fights their case in immigration court, wins relief like 42B (Cancellation of Removal for certain non-permanent residents), or another form of protection — and then still isn’t free?

That’s where the system starts to feel backwards to many families.

When someone wins relief under section 42B, an immigration judge has already decided that:

• The person meets the statutory requirements

• They’ve likely been in the U.S. for many years

• They have good moral character

• Their removal would cause exceptional and extremely unusual hardship to qualifying U.S. citizen or lawful permanent resident family members

That’s not sympathy. That’s a legal standard written into federal law.

Yet even after winning, the Department of Homeland Security (DHS) can reserve appeal or file an appeal to the Board of Immigration Appeals (BIA). During that window, the case is not considered “final.” That’s why detention can continue for a short period while DHS decides whether to challenge the ruling.

Legally speaking, DHS is allowed to appeal because immigration court is part of the executive branch. Just like a prosecutor in criminal court can appeal certain rulings, DHS attorneys can appeal an immigration judge’s decision if they believe there was a legal error.

But here’s the emotional reality people struggle with:

If the court system exists to determine eligibility for relief, and a judge says the person qualifies under the law, why does it feel like the government gets a second bite at the apple?

For families, that 30-day appeal window doesn’t feel procedural. It feels like continued punishment — even after someone has proven they qualify under the law.

This is where the conversation gets complicated. The same people who say “follow the legal process” often don’t realize that the legal process includes appeals — for both sides. Due process cuts both ways. Just as immigrants can appeal a denial, DHS can appeal a grant.

That doesn’t mean the system feels fair in practice. It doesn’t mean detention during that period feels humane. It doesn’t mean families don’t suffer in that waiting period.

But it does mean this isn’t rogue behavior — it’s built into the structure of immigration law.

If we’re going to talk honestly about immigration, we have to acknowledge two truths at the same time:

1. The law provides relief for certain undocumented immigrants.

2. The law also provides the government the right to challenge those decisions before they become final.

You can believe the appeal structure needs reform. You can argue detention during appeal is excessive. You can criticize how DHS exercises its discretion.

But it’s important to understand what’s happening legally before deciding who is “failing.”

The deeper issue isn’t that immigrants are avoiding the law. Many are navigating one of the most complex legal systems in the country.

The real debate is whether the structure of that system reflects the fairness and efficiency people expect — or whether it creates unnecessary hardship even after someone has already met the legal standard to stay.

It also underlines the urgent need to balance due process with compassion and justice in our immigration framework.
