Sexual harassment?

Let's look at the fact that the word "sexual harassment" refers to any act, speech, or expression of a sexual nature that causes others to feel embarrassed, frightened, annoyed, or offended by human dignity, and the offender does not consent to it.

The "sexually threatening" netted behavior is as follows:

✅ touching the body, such as holding the shoulder, embracing, cuddling, fondling, or touching in secret without permission.

✅ sexual banter or tease, such as mocking about shape, face, plunging, or using sexual profanity.

✅ lewd gestures, such as making lewd gestures or sending sexual symbols.

✅ sending lewd text messages, pictures or video clips via phone, social media or other channels.

✅ sexual assent threats, such as threatening to disqualify a job or providing benefits in exchange for sex.

❌ Thai law, "sexual harassment," there are provisions in many laws, such as the Penal Code, Article 397: Do not commit bullying, persecution, harassment of others, especially in public places, punishable by a fine of up to 10,000 baht.

❌ the Labour Protection Act 1998, section 16: prohibits employers or supervisors from sexually harassing employees.

❌ the Intersex Equality Act 2015: prohibits discrimination or harassment of persons on grounds of sex.

In short, sexual harassment is "making others uncomfortable or disgraced by sex without their consent," whether physical, verbal or online, is guilty.

✅ Supreme Court Judgment No. 6620 / 2014, the defendant was a supervisor, made lewd remarks and acts against the victim who was a henchman, such as teasing the shape, stroking the shoulder, putting the waist around the waist. The court deemed that an act of "sexual harassment" constituted sexual harassment in the workplace. Contravened the Labour Protection Act 1998, Section 16, employers have the right to disciplinary action.

✅ Supreme Court Judgment No. 2371 / 2017, the defendant touches the victim's chest and organs without consent, even without incest is an indecent act under the Criminal Code. Article 278 is punishable by up to 10 years in prison or a fine of up to 200,000 baht or a fine.

✅ Supreme Court Judgment No. 2846 / 2003. The defendant repeatedly made lewd remarks to the victim at work, humiliating the victim and daring not work.

The court deemed it a "verbal sexual threat" that engages, bullies or persecutes others without reasonable cause, according to the Penal Code, article 397.
