What should we do with the car crash?
When we drive to hit another car, whether it is 100% guilty or partially wrong, the responsibility arises in accordance with Thai law (Code of Pang and Commerce + Protection Act).

1) Civil liability (claims)
If we are negligently at fault, we are liable to indemnify the parties, such as the cost of repairing the car, the lack of benefit from using the car (such as rental car, or the proceeds of using the car), the medical expenses / injury compensation of the parties, such as property in the damaged car, the income of the injured person here can be paid through our car insurance, provided it is insured and protected by policy conditions.
2). Liability under the Car Insurance Act (Compulsory) shall pay primary medical expenses to the parties without prior proof of 30,000 Baht per person and additional pay for the offence up to 80,000 or 400,000, as the case may be.
⛔ but if we're wrong, we have to refund the insurance company in some cases, like drunk driving / no driver's license / running after a crash.
3.) Criminal liability (if any) if injured or killed, may enter the criminal code, such as negligence.
Others are hurt, careless, causing death to others, the penalty is both imprisonment and fine, but most of the time, the court is parole.

4.) Insurance policy liability (if insured) If there is a class 1 insurance, the insurer pays for the repair of the party car instead, we pay for the repair of our car. We only pay for the first part of the damage (if any) or excess. If there is a class 2 + / 3 +, the insurer pays for the repair of the party car (only in case of collision with a land vehicle).
⛔ if there is no insurance or it is ordinary 3rd class, must pay all by yourself.

การขับรถชนและเป็นฝ่ายผิดนั้น นอกจากความรู้เกี่ยวกับความรับผิดชอบทางกฎหมายแล้ว ผู้ขับขี่ยังควรมีความเข้าใจในขั้นตอนการจัดการอุบัติเหตุเพื่อให้สถานการณ์คลี่คลายอย่างรวดเร็วและถูกต้องตามกฎระเบียบ หลังจากเกิดอุบัติเหตุ สิ่งแรกที่ควรทำคือการ "ตั้งสัญญาณไฟฉุกเฉิน" และ "วางป้ายสามเหลี่ยม" เพื่อป้องกันอุบัติเหตุซ้ำซ้อน และเพื่อความปลอดภัยของทุกฝ่าย ต่อมาควรจัดการถ่ายรูปตำแหน่งรถทั้งสองคันและบริเวณเกิดเหตุ เพื่อเป็นหลักฐานประกอบการเคลมประกันและการแจ้งความ โดยต้องบันทึกข้อมูลคู่กรณีอย่างครบถ้วน เช่น เลขทะเบียนรถ ชื่อ-นามสกุล และข้อมูลติดต่อ ในกรณีที่มีผู้บาดเจ็บ ควรโทรแจ้งขอความช่วยเหลือทางการแพทย์ด่วนที่หมายเลข 1669 เพื่อให้ทีมแพทย์เข้าช่วยเหลือทันเวลา ทั้งนี้การโทรแจ้งประกันภัย (ถ้ามีกรมธรรม์) จะช่วยให้บริษัทประกันเข้ามาช่วยจัดการค่าซ่อมและค่าชดเชยต่าง ๆ ตามเงื่อนไขกรมธรรม์ได้อย่างรวดเร็ว สำหรับความรับผิดชอบทางแพ่งนั้น ผู้ที่เป็นฝ่ายผิดจะต้องรับผิดชอบค่าเสียหายต่าง ๆ เช่น ค่าซ่อมรถคู่กรณี, ค่ารักษาพยาบาล, และค่าชดเชยบาดเจ็บ รวมถึงค่าเสียหายอื่นๆ ด้วย ทั้งนี้สามารถใช้ประกันรถยนต์ในการช่วยจ่ายค่าใช้จ่ายเหล่านี้ หากมีการคุ้มครองตามกรมธรรม์ พ.ร.บ. รถยนต์ภาคบังคับนั้น ช่วยคุ้มครองค่ารักษาพยาบาลขั้นต้นแก่คู่กรณีถึง 30,000 บาทต่อคนโดยไม่ต้องพิสูจน์ความผิด และอาจจ่ายเพิ่มเติมสูงสุดตามอาการบาดเจ็บ อย่างไรก็ตามในบางกรณี เช่น เมาแล้วขับ หรือไม่มีใบขับขี่ จะต้องรับผิดชอบชดใช้คืนเงินบริษัทประกัน นอกจากความรับผิดชอบทางแพ่งและตาม พ.ร.บ. แล้ว หากเกิดการบาดเจ็บรุนแรงหรือเสียชีวิต อาจมีความรับผิดชอบทางอาญาเข้ามาด้วย เช่น ประมาททำให้ผู้อื่นได้รับบาดเจ็บหรือถึงแก่ความตาย ซึ่งอาจถูกตัดสินจำคุกหรือปรับได้ แต่ถ้าชดใช้ค่าเสียหายและตกลงยอมความ ก็สามารถลดบทลงโทษได้ ส่วนความรับผิดชอบตามกรมธรรม์ประกันภัยขึ้นอยู่กับประเภทของประกัน เช่น ประกันชั้น 1 บริษัทประกันจะช่วยซ่อมรถคู่กรณีและรถเราเอง โดยเราอาจเสียค่าเสียหายส่วนแรก (ค่า excess) แต่ถ้าเป็นชั้น 2+ หรือ 3+ บริษัทประกันจะจ่ายเฉพาะรถคู่กรณีเท่านั้น หากไม่มีประกันหรือเป็นประกันชั้น 3 ธรรมดา ผู้ขับขี่ต้องรับผิดชอบค่าเสียหายทั้งหมดด้วยตัวเอง ท้ายที่สุด การเตรียมตัวและรับมืออย่างถูกต้องเมื่อ "รถชนเราเป็นฝ่ายผิด" จะช่วยลดความยุ่งยากทางกฎหมายและค่าใช้จ่ายที่อาจเกิดขึ้น พร้อมรักษาความปลอดภัยและสิทธิของทุกฝ่ายได้อย่างเหมาะสม สิ่งสำคัญคืออย่าหนีหลังชน และปฏิบัติอย่างสุจริตเพื่อปกป้องสิทธิของตนเองและผู้อื่น
