Opposition to the use of electronic bangle (EM) measures, Dr. Thaksin Shinawatra

Dear Punishment Recess Commission Ministry of Justice through Commissioner of Canal Prem Central Prison

1. Corrections Act 2017

2. Corrections Department Regulation on the Suspension of Punishment, 2019 and as amended; and or other relevant legislation.

According to the Sanctions Rest Committee, the Ministry of Justice has considered approving the suspension of punishment for Dr. Thaksin Shinawatra, and enforcement measures have been considered in conjunction with the suspension of punishment by attaching the Bangle Electronic Tracking Device (EM).

I, Lt., developed Chaithep as a people who adhere to democracy.

This book is hereby filed to object to the attachment of such EM bangle devices.

With the following reasons, necessities and regulatory considerations:

# # 1.Guidelines according to Ministry Regulations and Corrections Department Regulations

According to the Ministry of Prisoners' Benefits Decree 2019 * * and as amended, including the Department of Corrections Regulation on Penalty Break Guidelines, EM Bangle is not an "absolute regulation" that applies to all prisoners, but a "discretion" that must be considered as appropriate.

* * * Precedence The use of the EM Bangle device is intended to prevent escape or recurrence. But considering that Dr. Thaksin is elderly (76 years old) and has a chronic illness (according to medical certificates and police hospital reports), you know that your physical condition is not favorable for fleeing or committing a crime that affects society.

* * * CASE STATEMENT: * * The remaining penalty is only 4 months out of a total penalty of 1 year. This is a very short period of time. The motivation for escape is therefore below the benchmark that requires strict EM control.

# # 2. The principle of equality and the spirit of the law (art. 44)

* * Article 44 of the Ministry Rules * * The Subcommittee has the power to consider "unconditional suspension" if there are reasonable grounds.

* * * Unfair discrimination: * * If other prisoners in the "elderly and sick" group are excluded from EM bangles, but Dr. Thaksin must be attached, both with social status and clear abode (Chanthulao House) may be considered contrary to the principle of equality.

* * * Reliability and control by other means: * * Probation can use other substitute methods, such as reporting to a scheduled misconduct worker, or demarcating areas without technical tools. Since the probationer is a public figure, probation can be easily pursued by the condition anyway.

Addiction to EM bangles in elderly people with congenital diseases, can cause daily living difficulties or affect medical care.

* * * Barriers to treatment: * * EM devices may interfere with the function of medical equipment, or cause irritation to the skin and physical condition of elderly patients.

* * * The rights of former country leaders: * * Although the law applies to everyone equally, past behavior that has benefited the nation and the people of Thailand is as follows:

It is evident to create structural changes for Thailand as follows:

* * * Change: * * Modify the public health system from "relief to the poor" to the "fundamental rights" of the people.

* * * Result: * * * Gives Thais access to standardized medical care, reduces Catastrophic Health Expenditure and becomes a model praised by the World Health Organization (WHO).

# # # 2. Economy and Community Foundations: Village Fund and One Parish, One Product (OTOP)

It is the direct distribution of resources into the locality to stimulate the foundation economy.

* * * Village Fund: * * * Allocate 1 million baht to all villages across the country as a renewable source of funding in the community.

* * * OTOP: * * Adopting local intellectuals to evolve into products for export, increasing commodity value and generating sustainable community income.

# # # 3.Administration: Bureaucratic Reform and "CEO, Prime Minister"

Dr. Thaksin adopted the concept of business administration in the bureaucracy.

* * * Setting up a new Ministry: * * There was a modernization of the Ministry of Defence, such as the establishment of the Ministry of Information and Communications Technology (ICT) and the Ministry of Culture.
