「子ども名義の口座＝教育費を貯めるのに安心」と思っていたのですが、調べてみると“名義預金”扱いになるリスクが意外と大きいと知ってヒヤッとしました。特に「通帳（銀行通帳）や印鑑、キャッシュカードを親が保管して、入出金も親が判断している」状態だと、名義は子どもでも“実質的な管理者は親”と見られやすい点が要注意です。 私が気をつけるようにしたのは、まず「そのお金は誰のものか」を説明できる形にしておくこと。例えば、お年玉や児童手当を子ども口座に貯める場合でも、親が自由に引き出して生活費に混ぜてしまうと、後から説明が難しくなりがちです。名義預金とは、ざっくり言うと“名義と実態がズレている預金”のこと。税務上は「実際に管理・支配しているのは誰か」で判断されるので、通帳管理が親のままだとアウト判定に近づきます。 贈与税の面では「年間110万円までなら非課税」という言葉だけが独り歩きしがちですが、ポイントは“贈与として成立しているか”。つまり、あげる側・もらう側の合意があり、記録が残っているかが大事です。私は対策として、少額でも（特に祖父母からの贈与がある年は）贈与契約書を作って日付と金額を残し、できるだけ現金手渡しより銀行振込にしました。振込にすると履歴が残るので、後から説明しやすいです。 さらに見落としがちなのが「成人したら本人へ」。成人後も親がずっと通帳管理を続けていると、名義預金とみなされる可能性が高まると聞き、我が家では“何歳で管理を渡すか”を先に決めておくことにしました。加えて、10年以上動きがないと休眠預金になる可能性もあるので、年1回でも記帳や少額の入出金で動かしておくと安心です。 最後に、教育費を貯めたい目的がはっきりしているなら、制度を使い分けるのも手です。年間110万円以内の贈与に収める、必要に応じて非課税制度（教育資金の一括贈与など）を調べる、そして“子どもの資産として管理している”と言える状態を作る。この3点を意識するだけで、子ども名義の口座デメリット（贈与税・相続税リスク）をかなり減らせると感じました。
