# EECThe Eastern Exclusive Economic Zone Act 2018 or EEC Act in law is obviously contrary to the 2017 Constitution, as the EEC law has stated that it contains certain provisions on the restriction of the rights and freedoms of individuals, the reasons and the need to restrict the rights and freedoms to carry out the systematic development of the Eastern area and in conformity with the principles of sustainable development, and in the same text it was also written in the draft SEC Act, doing as if the elimination of the rights and freedoms of individuals or citizens was common in countries with democratic political systems, governance by citizens and for citizens.
# Southern threatThe EEC law significantly reflects problems that are contrary to the principles under the right to development, and the SEC bill is repeating the EEC. It will create problems in southern areas that are contrary to the principles under the right to development of the local people. While major Thai and foreign capitalists / entrepreneurs who enter the SEC area are fully entitled to development through this SEC bill, both precipitating, excluding and slacking, posing a real threat to the public in the private sector, SME businesses and local government organizations will occur as soon as this bill is enforced.
The Discourse on the Development of the Eastern Special Development Region to contribute to sustainability proved that the EEC could not contribute to practical sustainability. To discuss sustainable development, the law must involve three important matters: economic, social and distracted development. When considering the structure of the EEC law, it focuses mainly on economic development, while environmental and social matters are very minor and almost nonexistent.
The draft SEC. Besides adopting the principle of sustainable development as a material shell, the contents of this draft do not contain any guidelines that indicate that the development will be designed to align with the public economy, only with the intention of depriving the public of all mechanisms to take over the resources of the southern region, to carry over capital and foreign groups, to make the people of the area become second-class citizens in their own land.

จากประสบการณ์ของผมในการติดตามการพัฒนากฎหมายเขตเศรษฐกิจพิเศษอย่างต่อเนื่อง พบว่า โครงการ EEC นั้นแม้ตั้งใจจะเร่งพัฒนาเศรษฐกิจ แต่การออกแบบกฎหมายและแผนปฏิบัติการได้ละเลยความสำคัญของสิทธิชุมชนและการรักษาสิ่งแวดล้อมอย่างแท้จริง ซึ่งสะท้อนชัดผ่านการจำกัดสิทธิเสรีภาพของประชาชนในพื้นที่ภาคตะวันออกทั้งในทางปฏิบัติและทางกฎหมาย เมื่อพิจารณาถึงผลกระทบที่จะเกิดขึ้นในภาคใต้จากร่างกฎหมาย SEC ก็ไม่ต่างกันมากนัก เพราะมีแนวโน้มว่าจะซ้ำรอยปัญหาที่เกิดขึ้นกับ EEC คือให้ความสำคัญกับการพัฒนาเศรษฐกิจโดยเฉพาะธุรกิจขนาดใหญ่ ภายใต้การเร่งรัดและยกเว้นมาตรการบางอย่าง ซึ่งเสี่ยงต่อการเบียดเบียนสิทธิของประชาชนในพื้นที่ เช่น ธุรกิจ SME และองค์กรปกครองส่วนท้องถิ่น รวมทั้งการจัดการทรัพยากรธรรมชาติที่อาจถูกแปรสภาพเพื่อประโยชน์เชิงพาณิชย์ของกลุ่มทุนทั้งในประเทศและต่างชาติ ในมุมมองส่วนตัว การพัฒนาที่ยั่งยืนควรผนวกทั้งเศรษฐกิจ สังคม และสิ่งแวดล้อมเข้าด้วยกัน แต่กฎหมายที่มีลักษณะเร่งรัดแบบนี้มักละเลยมิติทางสังคมและสิ่งแวดล้อม ทำให้ชุมชนท้องถิ่นและสังคมโดยรวมกลายเป็นผู้เสียผลประโยชน์ นอกจากนี้ การที่กฎหมายเหล่านี้ไม่ได้สนับสนุนการมีส่วนร่วมของประชาชนในกระบวนการตัดสินใจ ทำให้ชุมชนรู้สึกถูกกีดกันและมาตรการเหล่านี้อาจเปลี่ยนสถานะของประชาชนในพื้นที่ให้กลายเป็นพลเมืองชั้นสองในดินแดนของตนเอง จากประสบการณ์จริง การที่ภาครัฐและภาคประชาชนร่วมมือกันในการตรวจสอบและถอดบทเรียนจากผลการดำเนินงานของ EEC จะช่วยให้ภาคใต้สามารถพัฒนาอย่างสมดุลและสอดคล้องกับบริบทของพื้นที่ โดยไม่ละเมิดต่อสิทธิและเสรีภาพของประชาชน โดยเฉพาะการเน้นการพัฒนา SME และสร้างนวัตกรรมทางเศรษฐกิจที่ยั่งยืนและเป็นธรรม ท้ายสุดแล้ว เราควรตื่นตัวและมีส่วนร่วมในกระบวนการร่างและกำกับดูแลกฎหมายพัฒนาเขตเศรษฐกิจพิเศษ เพื่อให้มั่นใจว่าการพัฒนาทั้งเศรษฐกิจ สังคม และสิ่งแวดล้อมจะเกิดขึ้นอย่างแท้จริงและยั่งยืน เพื่อประโยชน์ของประชาชนทุกฝ่ายในระยะยาว
