The current Civil Code and Family Register Law presuppose marriage between men and women and do not recognize same-sex marriage.
Therefore, same-sex couples do not have legal and economic rights such as inheritance rights and tax deductions for spouses.
Another problem is that hospitals do not allow family visits, attendance, or consent decisions during surgery.
Physical and psychological burdens that do not have to be borne by opposite-sex couples are heavy on same-sex couples.
On February 14, 2019, 13 same-sex couples living in Japan sued the country all at once in Tokyo, Sapporo, Osaka and Nagoya, saying that it is unconstitutional that same-sex couples cannot marry (legal marriage). In September of the same year, they filed a lawsuit in Fukuoka, and in 2021, a secondary lawsuit began in Tokyo.
As of January 2026, a total of 12 district and high court judgments have been handed down, but 10 of them make it unconstitutional not to recognize gay marriage.
Sexual orientation, like gender and race, cannot be chosen or changed by one's own volition.However, same-sex couples cannot receive the legal status and rights that opposite-sex couples can receive by marriage.The ruling said that it is unconstitutional according to Article 14 of the Constitution that stipulates equality under the law, Article 24 of the Constitution that stipulates the dignity of individuals and the essential equality of both genders with respect to marriage, and Article 13 of the Constitution that stipulates the right to pursue happiness.
Same-sex marriage has become a global trend. In 1989, Denmark became the first country to adopt a registered partnership system, which gives same-sex couples almost the same rights as if they were married. In 2001, same-sex marriage was realized in the Netherlands. This trend has spread to Europe, North and South America, Oceania, and Asia (Taiwan). As of January 2025, same-sex marriage is available in 39 countries and regions. Among the G7 (seven developed countries), only Japan does not have legal guarantees for same-sex partners at the national level, and it has been pointed out that it is a human rights violation by the UN Human Rights Council and others (Reference: Marriage For All Japan - Freedom of Marriage for All "homepage).
In June 2019, three opposition parties, including the Japanese Communist Party (JCP), submitted a bill to the Diet to realize "marriage equality," which allows equal marriage regardless of sexual orientation.
In March 2023, the Japanese Communist Party submitted a bill to the House of Councillors to realize marriage equality with a focus on legalizing same-sex marriage. We will do our best to realize this bill. (Quoted from Japanese Communist Party Pledge)

私自身、同性婚について考えるようになったきっかけは、友人カップルの法的な壁に直面した話からでした。例えば、同性カップルには遺産相続や税務上の配偶者控除の適用がないため、生活の安定に大きな影響が出ています。病院での面会や手術同意が認められない事例も聞き、現行法の問題点を実感しました。 最近の日本では、複数の同性カップルが「憲法違反」として国を提訴し、多くの裁判所が同性婚を認めない現状を違憲と判断しています。これらは憲法14条、24条、13条に基づく違憲判決であり、法的な平等な権利の保障が求められています。私の周囲でも、同性婚への賛成の声が増えており、当事者だけでなく理解者も多いと感じます。 世界の状況を見ると、北欧や欧米諸国、そして台湾など多くの国で同性婚が認められ、法的保護や社会的受入れが進んでいます。一方で、G7の中で国レベルで同性パートナーへの法的保障がないのは日本のみであり、国際的にも遅れをとっています。私個人としては、日本でも早急に同性婚を法制化し、権利や尊厳が守られる社会になることを切に願っています。 また、同性婚反対派の意見も尊重しつつ、対話を深めていくことが大切だと思います。同性婚の問題は単なる法律の話にとどまらず、家族観、宗教観、文化的価値観にも関わる複雑なテーマです。だからこそ、多様な声を取り入れ、理解と共感が広がる社会を目指すべきです。 同性婚の議論は、いままさに日本の社会の未来を考える重要な局面にあります。私自身、同性婚にまつわる情報を集めながら、自分なりに考えを深めていきたいと思っています。同性カップルが法的にも社会的にも安心して暮らせる日が一日でも早く来ることを願い、そのためにできることを探し続けたいです。
