✅ Supreme Court Judgment No. 5328 / 2025:
= Case facts: 👨🏻⚖️❤️
1️⃣ Defendant 1 and Defendant 2 are husbands and wives who have property during marriage, "considered to be the marriage of the two defendants," and
2️⃣ Defendant I had sole title to the land, but acquired the land and buildings during his marriage to Defendant II.
It is therefore considered "a marriage between the two defendants" and
3️⃣ when the 1st defendant transfers the land to the 2nd defendant and the two defendants coexist with me and my wife, whose creditors still have the right to confiscate the land and the building.
To sell at auction, bring money to pay the debts owed by the 1st defendant; and
4️⃣ Therefore, the actions of the two defendants do not damage the creditor's rights. "There is no offence of defrauding the creditor," ✅ Article 350, Criminal Code. 👨🏻⚖️
🎉❤️ requires the manipulation of property so that the creditor does not receive the payment of all or part of the debt, so it is an offence to cheat the creditor, according to the Penal Code, article 350. ❤️🎉
