During medical stay (non-working), according to the Labour Protection Act, Article 32, third paragraph, it is prohibited to count such periods as general sick leave.

📍 the salary section. According to the Compensation Act, section 18, in cases where an employee does not work, the employer is required by law to pay a compensation (not called a salary wage) at 70 percent of the monthly wage.

The employer is also responsible for the rehabilitation of the work in the aftermath of the accident (Compensation Act, sections 15-18).

In the case that the employer counts the medical period as sick leave, the employer has committed a labor protection act and can complain at the Workers "Welfare and Protection Act (Section 49).
