My Seller Told Me: I’m Getting Divorced, But My Wife Doesn’t Know.
One of the hardest questions I ask sellers is:
“What is your current situation?”
Sometimes the answers aren’t easy.
I’ve had sellers tell me:
🏠 “I want to sell my house.”
💔 “I’m getting divorced.”
⚠️ “My spouse doesn’t know yet.”
At that point, the conversation changes.
As REALTORS®, our job isn’t simply to put a house on the market. We have to understand:
• Has a divorce been filed?
• Is the property marital property?
• Is the spouse on title?
• Is the divorce contested?
• Are there legal restrictions?
• Does everyone know the home is being sold?
Sometimes I don’t like the answers because they can create difficult situations, but asking the questions protects everyone involved.
Real estate is rarely just about the house.
It’s about understanding the entire story.
If you’re dealing with:
✔ Divorce
✔ Separation
✔ Life changes
✔ Relocation
✔ Estate issues
✔ Difficult family situations
Let’s have a conversation.

Selling a home during a divorce can be an emotionally charged and complex process that goes beyond typical real estate transactions. From personal experience assisting clients in such situations, I’ve found that clear communication and understanding the legal landscape are essential. Divorcing sellers often face uncertainty about property ownership and whether their spouse is aware of the sale, which can complicate negotiations and timelines. One important factor to consider is whether the divorce has been officially filed and if the property is categorized as marital property. This status affects how proceeds from the sale will be divided and what legal permissions are required to list the home. Additionally, when a spouse is on the title, their consent is typically necessary, and withholding this information can lead to legal disputes or delays. It’s also critical to ask whether the divorce is contested or amicable. Contested divorces can add layers of complexity, especially if there are disagreements over asset division, while amicable separations often allow smoother coordination in selling the home. Sellers should be aware of any court orders or legal restrictions that may limit their ability to sell or require court approval. In my experience, sellers who disclose their situation openly to their REALTOR® benefit from tailored advice and protection, enabling a smoother transaction. REALTORS® act not just as sales facilitators but as advisors who navigate these delicate circumstances with sensitivity and professionalism. If you’re facing life transitions such as divorce, separation, relocation, or estate matters, addressing these questions early can remove future obstacles. Consulting with legal professionals alongside your real estate agent can ensure compliance and peace of mind. Ultimately, selling a home during significant life changes is about more than the property itself—it’s about managing the entire story with empathy and clear guidance.
