🛠️ 5 important things employers to watch out for ❗

1️⃣ regulations must be clear. Not against the law.

📋 Every people employed must follow the same order.

And if the regulation is "against the law," even if the employee signs his consent, it is void. The employee can still sue, according to the Code of Commerce, section 150.

2️⃣ Make a mistake, not serious. Don't rush, lay off.

Such as being late for work, doing personal things at work, being on false sick leave.

📋 Employee makes no serious mistake = Must have a warning book first

Then, if you repeat the warning book within a year of the first offense,

Dismissal without compensation in accordance with Workers Protection Act Section 119 (4)

But if you don't issue a warning and immediately dismiss, you have to pay compensation.

3️⃣ Serious wrongdoing = no compensation paid

For example, quarrel, disrespectful speech, slander colleagues to the extent that they affect their work, damage their organization.

📋 When there is clear proof, the employer can dismiss immediately, not pay either.

- Compensation (Workers Protection Act Section 119 (2)

- Hire instead of notice (Code of Law and Commerce, Article 583)

- Unfair Dismissal Damage (Establishment of Labour Courts and Labour Procedures Act, Article 49)

4️⃣ the termination book. The reason must be clear.

📋 The employee made a mistake, but if the offence is not identified as a dismissal in the dismissal book = end

Finally, when the employee sues, he has to pay compensation.

5️⃣ use a language that employees understand.

📋 Every edition of the book should contain English or the employee's language.

Because if an employee claims to be ignorant, the employer is definitely at a disadvantage.
