Labour Protection Act
1. Maternity leave not exceeding 120 days 🤱🏻📅 (Article 41)
Prenatal check-up days and counting weekly holidays, traditional holidays
Employers pay wages not exceeding 60 days 💵 (Section 59)
It means that 60 days later, you get leave but you don't get paid.
2. Do not order any of the following hazardous work 🏗️🚫 (Article 39)
Work on machines or engines with vibrations.
Propulsion work or attached to a vehicle.
The work of lifting, carrying, carrying, carrying, towing, or carrying loads exceeding 15 kilograms.
Work done in a boat
Other work as prescribed in the Ministry Law
3. Do not work from 10: 00 pm to 6: 00 am 🤰🏻❌ (Article 39 / 1)
And no overtime work on holidays.
In the case of managerial positions, academic, administrative, accounting, financial work, the employee may be able to do overtime as far as health is not affected and the employee's consent is required first.
4. Do not terminate because of pregnancy (Article 43). In case of termination, employees have the right

Employment in lieu of notice. In the case of non-notice employer, 1 payment period of wages (Article 17)

Untapped vacation day wages include cumulative and section-based vacation days (section 67).

If the contribution is sent not less than 5 months within 15 months before the month of childbirth.
A maternity walkout allowance of 50% of the wages can be obtained for 90 days (except in the case of maternity, the 3rd person will not have this right) according to the Social Security Guidelines.

จากประสบการณ์ที่ได้พูดคุยกับหญิงมีครรภ์หลายๆ คนที่ทำงานประจำ สิ่งสำคัญที่เราควรเข้าใจอย่างลึกซึ้ง คือการรู้จักและใช้สิทธิตามกฎหมายแรงงานเพื่อปกป้องตนเองและลูกในครรภ์ได้อย่างเต็มที่ ข้อกฎหมายที่ได้กล่าวถึง เช่น สิทธิการลาคลอด 120 วัน ที่รวมทั้งวันตรวจครรภ์และวันหยุดต่างๆ นั้น ทำให้แม่ๆ สามารถดูแลสุขภาพได้ครบถ้วนโดยไม่ต้องกังวลเรื่องงานมากเกินไป สิ่งที่ต้องระวังคือการสื่อสารกับนายจ้างเพื่อให้เรื่องลาเป็นไปอย่างราบรื่น โดยเฉพาะสิทธิรับค่าจ้างครึ่งหนึ่งใน 60 วันแรก ซึ่งจะช่วยลดภาระทางการเงินได้มาก นอกจากนี้ การห้ามสั่งให้ทำงานที่เสี่ยงอันตราย เช่น งานที่ต้องยกของหนักเกิน 15 กิโลกรัม หรือทำงานกับเครื่องจักรที่มีความสั่นสะเทือน เป็นการคุ้มครองที่ช่วยป้องกันผลเสียต่อสุขภาพแม่และทารก การรู้สิทธิตรงนี้จะช่วยให้แม่มีข้ออ้างในการขอเปลี่ยนแปลงหน้าที่หรือเวรงาน ในส่วนของเวลาการทำงาน ก็มีการห้ามทำงานกลางคืนตั้งแต่ 22.00 น. – 06.00 น. และการทำโอทีต้องได้รับความยินยอมเท่านั้น ซึ่งช่วยลดความเสี่ยงต่อสุขภาพจากการอดนอนหรือความเครียด ถ้าเกิดกรณีเลิกจ้างเพราะตั้งครรภ์ หญิงมีครรภ์จะได้รับค่าชดเชยและสิทธิอื่น ๆ ที่กฎหมายแรงงานให้ไว้ ซึ่งหากพบการละเมิดควรรีบดำเนินการตามกฎหมายแรงงานทันที สุดท้าย อย่าลืมใช้สิทธิประกันสังคมที่สำคัญมาก เช่น การได้รับเงินสงเคราะห์การหยุดงานคลอดบุตร 50% ของค่าจ้าง เป็นเวลา 90 วัน โดยเฉพาะหากมีการส่งเงินสมทบครบตามเงื่อนไขก่อนคลอด ซึ่งจะลดภาระค่าใช้จ่ายและเพิ่มความมั่นคงทางการเงินให้คุณแม่ในช่วงเวลาที่สำคัญนี้ การรับรู้และเข้าใจสิทธิลูกจ้างหญิงมีครรภ์อย่างละเอียด เป็นเครื่องมือชั้นเยี่ยมที่จะช่วยให้แม่ๆ รู้สึกมั่นใจและปลอดภัยมากขึ้นในช่วงเวลาทำงานและตั้งครรภ์ พร้อมสร้างบรรยากาศการทำงานที่เป็นธรรมและเอื้ออาทรต่อแม่และเด็กในอนาคตได้อย่างแท้จริง
