Passed Agenda 1, the Labour Protection Law.
On September 24, the House of Representatives unanimously adopted two labour protection bill principles proposed by the People's Party, the essence of which is to reduce working hours, increase holidays, and expand leave entitlements in a variety of dimensions, so as to enhance the quality of life of workers in line with the current context.
Reduce Working Hours - Increase Weekly Holidays
The first draft, proposed by Chonburi MP Chonburi, requires employees to work no more than 40 hours a week, from the original 48 hours, and if it is a health-threatening job, no more than 35 hours a week.
It also increases the weekly holidays to no less than 2 days. Spaced up to 5 days apart and adjusts the annual rest leave to no less than 10 working days for employees who have completed 120 days (from the original one year).
Variety of leave rights - non-discrimination
The second draft, proposed by Miss Wan Vipha Pine, an MP for Roster, the People's Party, emphasizes equal protection of workers' rights, requiring employers not to discriminate, whether on gender, disability, religion or political attitudes.
Female employees are entitled to a period of up to 3 days per month without taking sick leave, and all employees are entitled to leave for close care of a person for up to 15 days per year. If 5 days or more of leave, the employer can apply for a medical certificate or an accompanying death certificate.
The bill also requires establishments to provide space and equipment for breastfeeding or squeezing milk in the workplace, at least 2 times a day, 30 minutes at a time, within 8 hours of work, and provides this right to cover at least 1 year after birth.
This resolution echoed the consensus of all political parties, with Mr. Jairus' draft receiving 333 votes in favour, 4 abstentions and 31 extraordinary commissioners. The draft of Ms. Wan Vibha received 329 votes in favour, 2 abstentions, 39 extraordinary commissioners, requiring no less than one third of women's organizations to be represented.
The passing of Agenda 1 is an important step towards improving workers' rights as far as the world has changed, reducing invisible costs such as exhaustion, accidents and resignation from despair, reiterating that labour is not just an "inputs," but a people with the right to rest, care for their families and work with dignity.
หลังจากผ่านวาระที่ 1 ของกฎหมายคุ้มครองแรงงาน พรรคประชาชนได้แสดงให้เห็นถึงความมุ่งมั่นที่จะปรับปรุงสิทธิแรงงานในหลายประเด็นสำคัญ อาทิ การลดชั่วโมงการทำงานต่อสัปดาห์ให้เหลือไม่เกิน 40 ชั่วโมง และสำหรับงานที่เสี่ยงต่อสุขภาพลดเหลือ 35 ชั่วโมง เพื่อเพิ่มเวลาพักผ่อนและฟื้นฟูร่างกายสำหรับแรงงาน นอกจากนี้ การเพิ่มวันหยุดประจำสัปดาห์ให้ไม่น้อยกว่า 2 วัน ช่วยให้แรงงานมีเวลาพักผ่อนอย่างเพียงพอ ลดความเครียดและความเสี่ยงในการประสบอุบัติเหตุจากความเหนื่อยล้า สิ่งที่น่าสนใจอีกอย่างคือการขยายสิทธิลาหลากหลายแบบโดยไม่เลือกปฏิบัติ ไม่ว่าจะเป็นเพศสภาพ ความพิการ ศาสนา หรือทัศนคติทางการเมือง ซึ่งช่วยส่งเสริมความเท่าเทียม และความเป็นธรรมในสถานที่ทำงาน การให้ลูกจ้างหญิงมีสิทธิลากรณีมีประจำเดือนไม่เกิน 3 วันต่อเดือนโดยไม่ถือเป็นวันลาป่วย ถือเป็นการตระหนักถึงสุขภาพและความต้องการเฉพาะตัวของแรงงานหญิง นอกจากนี้การให้สิทธิลาเพื่อดูแลบุคคลใกล้ชิดได้ไม่เกิน 15 วันต่อปี ยังสะท้อนการใส่ใจเรื่องครอบครัวและความรับผิดชอบของลูกจ้าง กฎหมายยังส่งเสริมสวัสดิการแม่และเด็กด้วยการกำหนดให้สถานประกอบการต้องจัดพื้นที่และอุปกรณ์สำหรับให้นมหรือบีบน้ำนมอย่างเหมาะสมในที่ทำงาน เพื่อส่งเสริมสุขภาพแม่และเด็ก รวมทั้งเพิ่มคุณภาพชีวิตและลดความกังวลของแม่ที่กลับไปทำงานหลังคลอด ทั้งนี้การผ่านวาระที่ 1 นี้ได้สะท้อนถึงการร่วมมือจากหลายฝ่ายและความเห็นพ้องต้องกันในระดับสภาผู้แทนฯ ซึ่งจะมีคณะกรรมาธิการวิสามัญและตัวแทนจากองค์กรด้านสตรีเข้ามาร่วมพิจารณาเพื่อให้กฎหมายนี้สมบูรณ์และเหมาะสม เพื่อให้กฎหมายคุ้มครองแรงงานนี้เป็นเครื่องมือสำคัญในการพัฒนาแรงงานไทยให้มีคุณภาพชีวิตที่ดีขึ้น ลดต้นทุนที่เกิดจากความอ่อนล้าและอุบัติเหตุ รวมทั้งสร้างสังคมแรงงานที่มีเกียรติและศักดิ์ศรีในโลกที่เปลี่ยนแปลงไปอย่างรวดเร็ว โดยรวมแล้ว นี่คือก้าวสำคัญที่สะท้อนการเปลี่ยนแปลงในภาคแรงงานไทยที่ไม่ใช่แค่ปัจจัยการผลิต แต่เป็นประชาชนที่มีสิทธิในการพักผ่อน ดูแลครอบครัว และทำงานอย่างมีคุณค่าและศักดิ์ศรี จึงเป็นกฎหมายที่ควรได้รับการสนับสนุนและติดตามอย่างใกล้ชิดเพื่อผลลัพธ์ที่แท้จริงสำหรับผู้ใช้แรงงานในอนาคต
