# From "Hyde Park" to "Thailand Sandbox": Why Thailand will be the first country where democracy blooms the world

If Thailand can successfully push the * * "Creative Democratic Area Act" * * *, we will not only follow in the footsteps of the West, but will be the * * "First country in the world" * * * to raise freedom to become a national innovation and create the most advanced democratic model in the 21st century.
# # Why would this law make Thailand overtake all countries around the world?
While most developed countries still use regular legal systems to control expression, making people vulnerable to lawsuits from capital or authority groups (SLAPP, silencing cults), the Thai Creative Democracy Area will break down that wall with three superiority that the world has never had:

จากประสบการณ์การติดตามและศึกษาเรื่องการมีส่วนร่วมทางการเมืองในหลายประเทศ ผมเห็นว่าสิ่งที่ร่างพระราชบัญญัติเขตพื้นที่ประชาธิปไตยสร้างสรรค์ของไทยกำลังจะทำ คือการปฏิวัติวิธีคิดเรื่องเสรีภาพในการแสดงออกและการมีส่วนร่วมของประชาชนในฐานะผู้ร่วมกำหนดนโยบายอย่างแท้จริง ในประเทศตะวันตก เช่น อังกฤษ กับจุดเริ่มต้นของ Speakers' Corner ที่ไฮด์ปาร์ก ถึงแม้จะอนุญาตให้พูดแสดงความคิดเห็นได้อย่างเสรี แต่ก็ยังไม่มีการคุ้มครองพิเศษทางกฎหมายสำหรับผู้แสดงความคิดเห็น ทำให้ยังมีข้อจำกัดในเชิงปกป้องสิทธิเสรีภาพอย่างเต็มที่ อีกทั้งเสียงของประชาชนในพื้นที่เหล่านั้นก็ไม่มีช่องทางเชื่อมโยงไปสู่การเปลี่ยนแปลงนโยบายในทางปฏิบัติ ส่วนฮ่องกงเองก็เคยพยายามนำโมเดลนี้มาใช้ แต่ความล้มเหลวเกิดขึ้นเนื่องจากขาดการสนับสนุนและรองรับอย่างเป็นรูปธรรมจากภาครัฐ ซึ่งแสดงให้เห็นว่าการมีพื้นที่พูดอย่างเดียวไม่เพียงพอ หากไม่มีการรับฟังและเชื่อมโยงไปสู่การบริหารประเทศในระดับนโยบาย ในทางกลับกัน ร่างกฎหมายใหม่ของไทยนั้น ก้าวล้ำไปอีกขั้นด้วยการเสนอให้มี Legal Safe Zone ที่คุ้มครองทางแพ่ง อาญา และปกครองอย่างเฉพาะเจาะจงในพื้นที่จริง เพื่อให้ประชาชน นักวิชาการ และเยาวชนกล้าแสดงความคิดเห็นและนำเสนอไอเดียได้โดยไม่ต้องกลัวผลกระทบทางกฎหมาย สิ่งนี้โดดเด่นและแตกต่างจากที่อื่นอย่างชัดเจน ผมเห็นด้วยอย่างยิ่งกับแนวคิดการทำ Policy Sandbox หรือห้องแล็บนโยบาย ที่จะทำให้ข้อมูลและข้อเสนอจากพื้นที่จริงถูกส่งต่อไปยังรัฐบาลโดยตรง นอกจากนี้การตั้งพื้นที่นำร่องอย่างน้อยจังหวัดละหนึ่งแห่งทั่วประเทศยังช่วยกระจายพลังประชาธิปไตยให้คลอบคลุมทั่วทุกภูมิภาค ไม่ใช่กระจุกอยู่แค่ในเมืองหรือศูนย์กลางอำนาจแต่เพียงแห่งเดียว ทั้งหมดนี้เป็นการสร้างฐานประชาธิปไตยที่แข็งแกร่งและยั่งยืน ผมจึงเชื่อว่าไทยจะกลายเป็นแบบอย่างของประเทศที่สร้างมาตรฐานใหม่ในการส่งเสริมประชาธิปไตยและเสรีภาพในการแสดงออก โดยไม่ใช่แค่ท่องตามระบบประชาธิปไตยตะวันตกเท่านั้น แต่เป็นการรังสรรค์นวัตกรรมที่เหมาะสมกับบริบทและความต้องการของประเทศไทยในศตวรรษที่ 21 อย่างแท้จริง นอกจากนี้การที่ร่างกฎหมายนี้สามารถยืนหยัดท่ามกลางความท้าทายทางการเมืองและสังคมได้ จะยิ่งทำให้ไทยได้รับการยอมรับในฐานะเมืองหลวงแห่งนวัตกรรมทางประชาธิปไตยของโลก เป็นการเพิ่มความมั่นใจให้กับประชาชนทั่วประเทศว่าเสียงของพวกเขานั้นมีความหมายและสามารถเปลี่ยนแปลงบ้านเมืองไปในทางที่ดีขึ้นได้จริง
