About the proposal of a new constitution for the reform of the country, democracy and the monarchy.

Your Majesty.

Thank you for the dust of your Majesty.

The Buddha, the Lieutenant of Police, developed Chaithep, begged the King of the Holy Sepulchre, proposed a new constitutional drafting approach to national reform, building a strong democracy, and public administration tied to the people, with the following essence:

1. Source of the country leader

Designates the President to be the head of the executive branch, elected directly by the people throughout the Kingdom, with the authority responsible for security, defense and foreign affairs.

2. Prime Minister and Administration

The Prime Minister comes from a majority in the House of Representatives, and is appointed by the President, with authority for economic and public administration.

3. Monarchy

It holds the monarchy above political conflict, embodiments the minds of the nation, and establishes its monarchical role under the Constitution, studying approaches from the style of the monarchy of Japan.

4. Parliamentary system

Use a unicameral system, where members are elected by the people, and strengthen the commissioner system and the participation mechanism of the people's sector, to monitor the use of state power, studying guidelines from the unicameral model of South Korea.

5. Police reform

• Executive Source: Requires that the national police commissioner is elected by police commissioners throughout the country.

• Monitoring Mechanism: Establish a public sector organization to supervise and monitor police operations, with the authority to inspect, propose removal or take disciplinary action against the Commissioner of the National Police.

• Independence of prosecution: Provide investigators with the independence to see and order cases, ready to be guaranteed the same independence of duty as the prosecution.

6. Reform of the State tax and revenue system

Abolish individual and corporate taxation in its original form; modify it to the state service fee system and resource management, e.g.

• Infrastructure use fees

• Concessions and benefits from natural resources

• Consumption fees for luxury goods

• Financial transaction fees

Ready to guarantee basic rights to public health, basic education, welfare of the elderly and the disabled, with the State allocating income from fees and enterprises to adequately support public services.

7. Bureaucratic reform and decentralization

Abolish regional government administration to reduce centralization of power; modify the position of governor from appointment to election by the people of the area; transfer power, budget, and mission to the localities; so that the direction of development and self-administration can be determined independently, streamlined, and meet the needs of the people.

8. Reform of courts and independent bodies

Reform the origin and balance check systems of the Constitutional Court, the National Commission for the Prevention and Suppression of Corruption (NCC) and the Election Commission (SEC) to be anchored to the people and Parliament, with incumbents subject to parliamentary approval by a vote of no less than two-thirds.

Determine constitutional jurisdiction to consider only preferences with the Constitution, prohibiting interference with or removal of political office holders from making policy decisions based on the scope of authority of law.

9. Amnesty and reconciliation

Consider amnesty for citizens of all parties in cases involving political conflicts fairly, to give society a fresh start, to establish truth-finding committees, to gather facts about political conflicts, to build a common understanding of society, and to lay the foundation for peaceful coexistence.

10. Prevention of the seizure of power and coups.

To preserve democracy, EFA sovereignty, and the rule of law, no person shall use power outside the constitutional framework to seize or alter the governing power, in the following principles:

1) Seizure of power, coup d'état, or subversive exercise of power does not give rise to constitutional legitimacy.

2) The use of force, weapon or any other means to alter the dominion is the ultimate offence.

3) Civil servants, government officials, and the military are responsible for guarding the Constitution and must reject the seizure of power, without being able to adopt such a wrongful order as an exemption from liability.

4) The people have the constitutional right and legitimacy to resist and do not accept the exercise of power that came from the coup.

5) Do not enact amnesty laws or amend the Constitution to guarantee legitimacy or waive liability for all coup perpetrators.

6) Constitutional courts and organizations are responsible for guarding this principle and forbidding the legitimacy of the exercise of power from any seizure of power.

11. Establishment of a transitional interim Government.

The beggar has appointed Dr. Thaksin Shinawatra as Prime Minister to form a government in the transition to a new constitutional democracy with a four-year term from the date of his appointment and to hold a new constitutional general election at the expiration of his term.
