Court, President prepares to prosecute people-media publish distorted clips
August 25, 2025 The Constitutional Court issued a statement clarifying the case, an audio clip was released from the witness hearing in the Ministerial Status Judgment case of Prime Minister Miss Rafthong Shinawatra on August 21, with the clip claiming that the Constitutional Court Judiciary said "sit down, son" while inquiring the respondent.
The Constitutional Court confirmed that the words in the audio clip do not match the facts, and the actual wording is "Sit down," which is the customary politeness of the trial. The court found that the dissemination of information that is inaccurate from reality is a distortion that may cause misunderstanding among the public and affect the image of the Constitutional Court.
Pursuant to the Organic Act on Constitutional Court Procedure, 2018, Article 38, the Court has placed an injunction prohibiting participants from listening to the inquest, publishing or distorting any material from the date of the hearing; by which the act may net the offence under the Computer Offences Act 2007 and may constitute a violation of the jurisdiction under Articles 38 and 39, as well as the Constitutional Court Requirements on Judicial Procedure, 2019.
The Office of the Constitutional Court stated that it would take decisive legal action against those who disseminate such disinformation, to preserve the validity of judicial proceedings and strengthen public confidence in the operation of the Court.
ในช่วงเวลาที่มีการเผยแพร่ข้อมูลหรือคลิปเสียงเกี่ยวกับกระบวนการพิจารณาคดีของศาลรัฐธรรมนูญ ความถูกต้องและความน่าเชื่อถือของข้อมูลถือเป็นหัวใจสำคัญที่ต้องได้รับการดูแลอย่างเคร่งครัด เนื่องจากข้อมูลเหล่านี้มีผลกระทบต่อความเชื่อมั่นของประชาชนต่อระบบยุติธรรมในประเทศ โดยเฉพาะในกรณีของคดีวินิจฉัยสถานะรัฐมนตรี ซึ่งเป็นประเด็นทางการเมืองและสาธารณะที่ละเอียดอ่อน ศาลรัฐธรรมนูญจึงได้ออกมาตรการเพื่อป้องกันการเผยแพร่ข้อมูลที่คลาดเคลื่อนหรือบิดเบือน ซึ่งนอกจากจะผิดกฎหมายตามพระราชบัญญัติว่าด้วยการกระทำความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ. 2550 แล้ว ยังถือเป็นการละเมิดอำนาจศาลตามมาตรา 38 และ 39 ของพระราชบัญญัติประกอบรัฐธรรมนูญว่าด้วยวิธีพิจารณาของศาลรัฐธรรมนูญ พ.ศ. 2561 ด้วย เพื่อรักษาความเป็นธรรมของกระบวนการพิจารณา ศาลมีคำสั่งห้ามผู้เข้าร่วมฟังการไต่สวนเผยแพร่หรือบิดเบือนเนื้อหาการพิจารณาคดี ถือเป็นการส่งสัญญาณให้สังคมตระหนักถึงความรับผิดชอบในการเผยแพร่ข้อมูลข่าวสาร ในยุคที่ข้อมูลออนไลน์สามารถเข้าถึงง่ายและแพร่กระจายได้รวดเร็ว นอกจากนี้ การสร้างความเข้าใจที่ถูกต้องเกี่ยวกับคำพูด "นั่งลงครับ" ที่ถูกบิดเบือนในคลิปเสียง ยังเป็นอีกหนึ่งตัวอย่างของการที่สังคมควรใช้วิจารณญาณและติดตามข้อมูลจากแหล่งข่าวที่น่าเชื่อถือ เพื่อป้องกันการเกิดความเข้าใจผิดที่อาจส่งผลกระทบต่อภาพลักษณ์และความน่าเชื่อถือของสถาบันสำคัญอย่างศาลรัฐธรรมนูญ ท้ายที่สุดแล้ว การดำเนินการทางกฎหมายกับผู้เผยแพร่ข้อมูลบิดเบือนในครั้งนี้ จะเป็นการยืนยันถึงความเด็ดขาดและความรับผิดชอบต่อการรักษาความยุติธรรมในสังคม เป็นการส่งเสริมให้ประชาชนมีความเชื่อมั่นและเห็นความสำคัญของกระบวนการยุติธรรมที่โปร่งใสและเป็นธรรมในประเทศ
