📘 Rule 1672 / 2569. The situation in which the two defendants drove a motorcycle and sat at the end and brought a firearm with them with the purpose of shooting at the crime scene, as the two defendants had ordered. When they reached the crime scene, the 1st defendant parked the motorcycle. Then the 2nd defendant used a firearm to shoot into the crime scene home, which was the residence of the two victims and their children. The bullet penetrated the wall of the house and was at the level of the neck. Both defendants could see that the shot could hit both victims or someone else inside the house, even if the bullet was No one, because the two victims had cut their tires and taken their sons to their relatives. At the time of the incident, no one was in the house. The actions of the two defendants were considered guilty of jointly trying to kill others. And the two defendants' sharing with them was pre-planned by preparing motorcycles and firearms to shoot at the crime scene. The appointment of both defendants to take their firearms to a hidden place step by step is considered a premeditated act. When the two victims did not die, both defendants and they were guilty of jointly trying to kill others on premeditated basis. According to P.O., section 289 (4) comprises section 80.

เมื่ออ่านฎีกาคดีนี้ ผมสะท้อนถึงความสำคัญของเจตนาและการวางแผนในคดีอาญา แม้ว่าขณะเกิดเหตุผู้เสียหายจะไม่อยู่ในบ้าน แต่ศาลก็พิจารณาว่าจำเลยได้เล็งเห็นถึงผลที่อาจเกิดขึ้นกับบุคคลภายในบ้าน นั่นแสดงให้เห็นว่าศาลยึดหลักความมีเจตนาร้ายและไตร่ตรองไว้ล่วงหน้าเป็นหลักสำคัญในการพิสูจน์ความผิดตาม ป.อ.มาตรา 289(4) จากประสบการณ์ที่ผมได้ศึกษาคดีแบบนี้ในเนติบัณฑิต พบว่ากระทำด้วยความตั้งใจและเตรียมการอย่างเป็นขั้นตอน ไม่ว่าจะเป็นการนัดหมาย อาวุธปืน หรือรถจักรยานยนต์ ล้วนสะท้อนการวางแผนที่มีเจตนาในการก่ออาชญากรรมอย่างชัดเจน ทั้งนี้การยิงปืนกราดแม้ว่าจะไม่ได้ทำให้ผู้ใดถึงแก่ความตาย แต่ก็เป็นการกระทำที่มีอันตรายอย่างยิ่งและศาลก็สั่งให้มีความผิดฐานพยายามฆ่า เรื่องนี้ยังเน้นย้ำว่าการที่บ้านไม่มีคนอยู่ถือเป็นกรณีบังเอิญและไม่ได้ทำให้โทษทางอาญาลดหย่อนลง ศาลพิจารณาจากเจตนาและเหตุการณ์ที่เกิดขึ้นจริงเป็นหลัก สิ่งที่ผมได้เรียนรู้คือผู้สอบกฎหมายควรศึกษาแนวคำพิพากษาในลักษณะนี้เพื่อเข้าใจเจตนาและองค์ประกอบของความผิดในคดีอาญาที่เกี่ยวข้องกับการยิงปืนกราด แม้จะไม่มีผู้ได้รับบาดเจ็บก็ตาม ในฐานะนักศึกษากฎหมายหรือผู้เตรียมตัวสอบที่เกี่ยวกับคดีอาญา การทำความเข้าใจรายละเอียดเงื่อนไขและความเห็นของศาลในการวินิจฉัยเภทผิสำคัญมาก เพราะจะช่วยให้สามารถนำไปใช้วิเคราะห์สอบและเขียนคำแนะนำทางกฎหมายได้อย่างมีประสิทธิภาพ นอกจากนี้ยังเป็นการเตือนใจว่าแม้เหตุการณ์จะไม่ส่งผลถึงความตาย แต่เจตนาและพฤติกรรมก็ทำให้ผู้กระทำผิดต้องรับโทษอย่างเหมาะสมตามกฎหมาย
